Information Regulator Probes Data Brokers Over Privacy Concerns

The investigation focuses on defining electronic communication within the framework of the POPI Act, addressing the ambiguity that has allowed companies to contact consumers without explicit consent.
Tlakula emphasizes the necessity for businesses to lawfully obtain consumer contact details, regardless of the investigation's outcome. She stresses, "Even if we determine that a telephone does not constitute electronic communication, telemarketers cannot purchase and utilize personal information without proper consent. The law is clear."
Exceptions include situations where individuals intentionally make their personal information public or if the information is part of a public record.
